Activity Waiver and Release Information

In consideration of being allowed to participate in the activity, and for other good and valuable consideration, the receipt of which is hereby acknowledged, I, or the minor participant I registered for (“the participant”), agree with Ebike Freedom CIC of Unit 1A, Millennium Court, 9 Burns Street, Glasgow, G4 9SA (“the Activity Provider”) to the following:

1. Details of Activities:

   The participant will be participating in cycling-related activities provided by the Activity Provider. The participant understands that by taking part in this event, they are doing so voluntarily and at their own risk.

2. Assumption of Risk:

   I understand that cycling involves inherent risks, including but not limited to accidents, falls, weather conditions, and road hazards. I voluntarily assume all risks associated with this activity, including potential injury or damage.

3. Waiver and Release of Liability:

   On behalf of myself, my heirs, assigns, and personal representatives, I hereby release and discharge the event organisers, ride leaders, volunteers, sponsors, administrators, legal representatives, and assigns from any claims, liabilities, or damages arising from my participation in this event, notwithstanding that such damage, loss, or injury may have been caused solely or partly by the negligence of the Activity Provider. 

This waiver does not limit or exclude liability for death or personal injury caused by the negligence of the Activity Provider, its employees, or agents. 

   I understand that the participant would not be permitted to take part in the activity unless they acknowledge this waiver.

4. Fitness to Participate:

   I certify that I am physically fit to participate in this cycling event and that I have no medical conditions, physical limitations, or disabilities that would affect my ability to ride safely. If required, the participant will obtain a medical examination and clearance.

5. Equipment:

   I acknowledge that it is my responsibility to ensure my bike is in roadworthy condition and that I will wear appropriate safety gear, including a helmet. If I choose to borrow equipment, I accept full responsibility for its use.

6. Emergency Medical Treatment:

   In the event of an emergency, I authorise the event organisers to seek medical assistance on my behalf if needed.

7. Minors:

   If the participant is under 16 years of age, they must be accompanied by a responsible adult during the event. The accompanying adult assumes full responsibility for the minor’s safety.

8. Insurance:

   I understand that the Activity Provider does not provide personal insurance coverage. It is my responsibility to ensure that I have adequate insurance for cycling and outdoor activities.

9. Data Protection (GDPR):

   The Activity Provider will process personal data provided in this form in accordance with the General Data Protection Regulation (GDPR). Personal data will only be used for the purposes of event organisation and safety and will not be shared with third parties without consent.

10. COVID-19 Precautions:

   I am responsible for adhering to any current public health guidelines, including those related to COVID-19, and understand that participation in this event is at my own risk.

11. Acknowledgement of Understanding:

   The participant acknowledges and agrees that: 

   (1) The Activity Provider has given the participant sufficient time to carefully read this waiver. 

   (2) The participant has been given the opportunity and is encouraged to seek independent legal advice before agreeing to this waiver. 

   (3) The participant fully understands the risks and claims being waived in order to participate in the activity.

12. Timeframe:

   This waiver applies to all activities associated with this event and future events organised by the Activity Provider, unless revoked or amended.

I acknowledge that I have read, understood, and agree to the terms outlined in this waiver and release form.
